Client Services Agreement.

1. Acceptance of Terms
 

By accessing or using any service provided by ALS WorkWell Solutions (“we”, “us”, “our”), including coaching, counselling, CBT, or clinical psychology sessions, you (“you”, “the client”) agree to be bound by the terms outlined in this Client Service Agreement. If you do not agree, you should not use our services.

IMPORTANT: ALS WorkWell Solutions is not a crisis or emergency service. If you are in immediate danger or need urgent support, please contact your GP, NHS 111, Samaritans (116 123), or emergency services (999).

2. Scope of Services
 

ALS WorkWell Solutions acts solely as a referral and booking facilitator, coordinating access to a range of coaching and therapeutic services delivered by independent, self-employed professionals. ALS does not provide or clinically supervise these services.


Services include:
 

  • Life, personal development, business, and executive coaching (non-clinical)

  • Counselling and talking therapies

  • Cognitive Behavioural Therapy (CBT)

  • Clinical psychology and related psychological services

All services are provided by qualified, independent practitioners. ALS WorkWell Solutions Ltd does not employ, manage, or clinically oversee these professionals.

3. Independent Practitioners and Liability
 

You acknowledge and agree that:
 

  • ALS WorkWell Solutions facilitates access to services including coaching, counselling, CBT, and clinical psychology. All counselling, CBT, psychology, and other therapeutic services are delivered by independent, self-employed practitioners, who are solely responsible for their conduct, qualifications, professional registration, and insurance.

  • Coaching services may be delivered by either the owner of ALS WorkWell Solutions or by other independent, self-employed coaches. In all cases, coaching is non-clinical and does not constitute therapeutic, diagnostic, or regulated mental health care.

  • ALS WorkWell Solutions does not directly deliver, supervise, or employ any practitioner providing therapeutic or psychological services.

ALS WorkWell Solutions accepts no liability for the actions, outcomes, or conduct of any independent practitioner or coach, whether introduced by or operating in connection with our business. Your engagement with any practitioner, including for coaching, is done entirely at your own discretion and risk.

ALS WorkWell Solutions manages the administrative aspects of referrals, scheduling, invoicing, and client communications. We act as the commercial point of contact but do not enter into a clinical relationship with clients.

4. Practitioner Exclusivity and Non-Circumvention

​

By accessing services through ALS WorkWell Solutions, you agree that any practitioner introduced to you via ALS shall not be approached directly for further work outside our coordination for a period of 12 months following your last session with that practitioner.


Any future contact, booking, or payment must be arranged through ALS unless otherwise agreed in writing. ALS reserves the right to suspend services and recover financial or reputational losses resulting from a breach of this clause.

5. Your Responsibilities as a Client
 

By using our services, you agree and understand that:
 

  • You are responsible for your own physical, emotional, and mental wellbeing during and after any session.

  • ALS WorkWell Solutions is not an emergency or crisis service.

    • If you are in distress, at risk of harming yourself or others, or require immediate help, you must seek appropriate emergency support from your GP, NHS 111, Samaritans (116 123), or call 999.

  • Coaching, therapy, and psychological services are not substitutes for emergency medical, psychiatric, or legal care.

  • You will provide any necessary disclosures to the Practitioner (e.g., medical or psychological history) and take responsibility for accessing appropriate professional care.

6. Confidentiality and Data Protection
 

We treat all personal information with confidentiality, subject to legal and ethical exceptions.

 

Confidentiality may be broken where:

​

  • There is a risk of harm to you or others

  • There is a disclosure of abuse (including children or vulnerable adults)

  • We are legally required to disclose (e.g., court order, terrorism laws)

  • All personal data is processed in line with our Privacy Policy and applicable laws including UK GDPR and the Data Protection Act 2018.

7. Fees, Payments, Cancellations, and Refunds
​

  • Fees must be paid in advance unless otherwise agreed.

  • All bookings, payments, and session confirmations are managed by ALS WorkWell Solutions. Sessions are deemed completed once confirmed by the practitioner.

  • Cancellations must be made at least 72 hours in advance. Late cancellations or no-shows may be charged at full rate.

  • Refunds are not guaranteed and are made at the discretion of the Company or the Practitioner.

  • Sessions and fees may vary depending on the Practitioner you are working with.

  • All packages expire 6 weeks from the date of purchase, unless explicitly stated otherwise in writing. After this period, any unused sessions will be forfeited and no refunds will be issued.

8. No Guarantees and Limitation of Liability
​

  • Outcomes from coaching or therapy cannot be guaranteed.

  • ALS WorkWell Solutions disclaims all warranties, express or implied.

  • To the maximum extent permitted by law, we will not be liable for any direct, indirect, incidental, or consequential damages.

  • Our total liability, if any, is strictly limited to the amount paid directly to ALS WorkWell Solutions by you in the 12 months preceding any claim.

  • ALS WorkWell Solutions maintains professional liability insurance. A copy of the certificate is available on request.

  • ALS WorkWell Solutions operates solely as a referral and booking facilitator. We do not guarantee or accept liability for the clinical or therapeutic outcomes of services delivered by independent practitioners.

9. Indemnity
 

You agree to indemnify and hold harmless ALS WorkWell Solutions, its directors, and staff against any claims or liabilities arising from:

​

  • Your use or misuse of our services

  • Your interactions with independent Practitioners

  • Any breach of this agreement by you

​

10. Professional Standards of Practitioners
 

All independent Practitioners are expected to be:
 

  • Appropriately qualified and insured

  • Registered with their respective governing bodies (e.g., BACP, HCPC, BABCP, Association for Coaching)

  • Responsible for complying with their professional code of ethics

  • Practitioners are required to meet insurance, qualification, DBS, and registration standards under their separate agreement with ALS WorkWell Solutions. ALS may verify compliance at its discretion but does not routinely supervise or monitor practitioners

11. Termination of Services
 

ALS WorkWell Solutions reserves the right to suspend or terminate access to services if:
 

  • There is a breach of these terms

  • There is misconduct, abuse, or risk to our business or staff

  • Services are deemed no longer suitable or safe
     

You may also stop using services at any time.

12. Force Majeure
 

We are not liable for delays or failures in service caused by events outside our control, including illness, technical failures, or natural disasters.

13. Intellectual Property

​

All materials provided as part of our services are protected by intellectual property laws. You may not copy, share, record, or reproduce any content without prior written permission.
 

14. Governing Law

​

This Agreement is governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

​

15. Dispute Resolution
 

In the event of a dispute, both parties agree to attempt informal resolution. If unresolved, mediation shall be pursued before any legal action is taken.

16. Client Acknowledgement

 

By engaging in coaching services provided through ALS WorkWell Solutions Ltd, you confirm and understand the following:
 

  • Coaching services delivered by the owner or an independent coach are non-clinical and do not constitute therapy, counselling, or mental health treatment.

  • If you engage in therapeutic services such as counselling, CBT, or clinical psychology, these are provided by independent, self-employed practitioners introduced or coordinated via ALS WorkWell Solutions.

  • ALS WorkWell Solutions does not directly deliver or supervise any counselling, CBT, or clinical psychology or therpeutic services and is not responsible for the conduct or outcomes of any such third party providers.

  • You are responsible for ensuring that the service you choose is appropriate to your needs and for seeking emergency or psychiatric care independently if required.

  • You have read and agree to this Client Service Agreement and understand the scope and limitations of the services provided.​
